These Terms & Conditions ("Terms") govern your access to and use of the LUME mobile application and related services provided by LUME Beauty Ltd. ("LUME," "we," "us," or "our"), a company based in London, United Kingdom. By creating an account, downloading the app, or otherwise using the Services, you confirm that you have read, understand, and agree to be bound by these Terms and any supplemental policies referenced herein. If you do not agree, do not access or use the Services.
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Services. If you are under 18, you represent that you have consent from a parent or legal guardian. You agree to provide accurate account information, keep your credentials secure, and promptly update any changes. You are responsible for all activity conducted under your account and must notify us immediately of any unauthorized use or suspected compromise.
LUME offers a suite of beauty and skincare related tools, including: (a) face scanning and color analysis to help understand skin tone and undertones; (b) AI-generated makeup looks and recommendations based on your uploaded face scans and onboarding questionnaire responses; (c) community forums for sharing questions, reviews, and inspiration looks; (d) product recommendations and saved product lists; and (e) premium subscription features such as extended generation limits and exclusive looks. Authentication is provided through Google OAuth. We may add, modify, or remove features at any time without prior notice.
To provide our Services, we collect: (a) Google OAuth data including your name, email, and profile photo; (b) face scans you upload, which we process using third-party AI services including OpenAI API (for makeup guides), Google Vision API (for facial landmark extraction), and Replicate's Google Nano-Banana model (for AI-generated makeup looks); (c) responses to our onboarding questionnaire about your age, skin characteristics, and beauty preferences; and (d) inspiration looks and other images you choose to share. Our data practices are fully described in our Privacy Policy. By using the Services, you consent to the collection and use of this information as described.
Certain features are available only through paid subscriptions purchased via the Apple App Store. All payment processing is handled by Apple and RevenueCat - we do not collect, store, or process any credit card information or payment details. By purchasing a subscription, you authorize Apple to charge your selected payment method according to their terms. All purchases are final and non-refundable per Apple's policies. Automatic renewals occur at the end of each billing period unless you cancel at least 24 hours before the renewal date through your Apple ID account settings. We may adjust pricing upon reasonable advance notice.
You agree to use the Services only for lawful, personal purposes and to follow our community standards. Prohibited activities include, but are not limited to:
We reserve the right to remove content, suspend functionality, or terminate accounts that violate these Terms or applicable law.
You retain ownership of face scans, inspiration looks, questions, reviews, and other materials you submit ("User Content"). By submitting User Content, you grant LUME a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, distribute, modify, translate, adapt, publicly display, and otherwise use the content to operate, promote, improve, and provide the Services. You represent and warrant that you have all rights necessary to grant this license and that your User Content does not infringe any third-party rights. For inspiration looks and other images you upload, you are solely responsible for ensuring you have the right to share those images and that they do not infringe any third-party intellectual property rights. We are not responsible for any intellectual property infringement or rights violations related to user-uploaded content. We may remove or refuse to display any User Content at our discretion.
Our Services leverage third-party machine learning models including OpenAI API, Google Vision API, and Replicate's Google Nano-Banana model to generate makeup looks, extract facial features, create makeup guides, provide product recommendations, and deliver educational content. These AI outputs are probabilistic and may not be accurate, complete, or suitable for your individual needs. The Services do not constitute medical, dermatological, or professional advice. Always perform a patch test, follow product instructions, and consult qualified professionals for personalized medical or skincare guidance. You are solely responsible for evaluating and relying on any AI-generated outputs. We are not responsible for the accuracy, reliability, or performance of third-party AI services.
We use third-party AI services to process your face scans and provide core functionality: (a) OpenAI API processes your images to generate makeup guides and tutorials; (b) Google Vision API analyzes your face scans to extract facial landmarks for color analysis and product recommendations; and (c) Replicate's Google Nano-Banana model generates AI-powered makeup looks. By uploading face scans, you consent to their processing by these third-party services. These services operate under their own terms of service and privacy policies. We are not responsible for their data handling practices, service availability, or the accuracy of their outputs.
Product recommendations, affiliate links, and third-party services are provided for convenience and may be based on user inputs, community reviews, facial feature analysis via Google Vision API, or partner data. We do not control or endorse third-party products or services and make no warranties regarding their safety, suitability, or availability. Transactions with third parties are solely between you and the third party, and LUME is not liable for any loss or damage arising from such dealings.
The Services, including all software, designs, text, graphics, logos, trademarks, and other proprietary materials, are owned by or licensed to LUME and are protected by intellectual property laws. Except for the limited rights expressly granted to you in these Terms, no rights are granted by implication or otherwise. You may not copy, modify, distribute, sell, lease, or create derivative works from any portion of the Services without our prior written consent.
Our handling of personal data is governed by the LUME Privacy Policy, which explains what information we collect, how we use it, and the choices you have. By using the Services, you acknowledge that personal data will be processed in accordance with the Privacy Policy. Certain features may access device sensors, photos, or health-related information; you can manage permissions through your device settings.
If you provide suggestions, feedback, or participate in beta programs, you grant us a perpetual, irrevocable, worldwide license to use such input without restriction or compensation. Beta or experimental features may be offered on an "as-is" basis and may be withdrawn at any time.
We may suspend or terminate your access to the Services, in whole or in part, at any time for conduct that we believe violates these Terms, applicable law, or is otherwise harmful to other users, third parties, or LUME. Upon termination, the rights granted to you under these Terms will cease immediately, but Sections that by their nature should survive will remain in effect (including payment obligations, user content license, disclaimers, limitation of liability, and dispute provisions). You may close your account at any time by following the instructions in the app.
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT REPRESENT OR WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT DEFECTS WILL BE CORRECTED.
TO THE FULLEST EXTENT PERMITTED BY LAW, LUME AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, LICENSORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICES, REGARDLESS OF THE THEORY OF LIABILITY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF USD $100 OR THE AMOUNT YOU PAID TO LUME FOR THE SERVICES IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
You agree to defend, indemnify, and hold harmless LUME and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with (a) your access to or use of the Services, (b) your User Content, or (c) your violation of these Terms or applicable law.
These Terms and any disputes arising out of or relating to them or the Services will be governed by the laws of England and Wales, without regard to conflict-of-law principles. Before filing a formal claim, you agree to first contact us at contact@lumebeauty.app and provide a written description of the dispute so we can attempt to resolve it informally. If we cannot resolve the dispute within 60 days, either party may pursue permitted remedies in the courts of England and Wales, and each party consents to the personal jurisdiction and venue of those courts. Nothing in this Section limits either party's right to seek equitable relief or to bring claims in small claims court where jurisdictional requirements are satisfied.
We may update these Terms from time to time to reflect operational, legal, or regulatory changes. If we make material changes, we will provide notice through the Services or by email. Continued use of the Services after the effective date of revised Terms constitutes acceptance of the changes.
